1. Service Overview

UGC.Prospect is an online service that helps UGC (User Generated Content) creators find prospects in the tourism and travel industry, generate personalised outreach messages using artificial intelligence, and send collaboration emails directly from the platform via Gmail or Outlook. The service is published by Marine Bunel, based in Quebec, Canada.

2. Account Access

Access to the service requires creating an account via Google. Some features require a paid subscription. Users agree to provide accurate information when registering and not to share their credentials. Connecting an email account (Gmail or Outlook/Hotmail) is optional and enables sending prospecting emails directly from the platform. Users must be at least 18 years old to use the service.

3. Subscriptions & Payments

Subscriptions are available at the following rates: Basic : 6€//month, Premium : 9€//month, Quarterly : 18€//month. Payments are securely processed by our PCI-DSS certified payment provider. Subscriptions renew automatically unless cancelled. No refunds are issued for partial periods.

4. Cancellation

Users may cancel their subscription at any time from their account settings or by contacting support. Cancellation takes effect at the end of the current billing period.

5. Use of Prospecting Data

Prospecting data provided by UGC.Prospect comes from publicly available online sources. UGC.Prospect does not guarantee the completeness, accuracy or currency of the information. Users agree to use this data and AI-generated messages in compliance with the GDPR, ePrivacy Directive and applicable laws in their country. UGC.Prospect is not liable for non-compliant use.

6. Acceptable Use

Users agree to use UGC.Prospect solely for lawful B2B commercial prospecting purposes. The following are strictly prohibited: (a) sending unsolicited messages to individuals (spam); (b) circumventing or attempting to circumvent platform technical limits; (c) accessing other users' data; (d) using the platform for illegal purposes or in breach of applicable anti-spam laws (GDPR, ePrivacy Directive, Canadian CASL, US CAN-SPAM Act); (e) reselling or redistributing obtained data. UGC.Prospect reserves the right to suspend any breaching account without notice.

7. Email Sending & Automatic Follow-ups β€” User Responsibility

When a user connects their Gmail or Outlook account, UGC.Prospect uses OAuth tokens to send emails on their behalf. The user is solely responsible for the content of emails sent, their compliance with anti-spam laws (ePrivacy Directive, GDPR, CAN-SPAM Act, CASL), and respect for recipients. Automatic follow-up feature (Premium subscription): users may configure automatic follow-up emails (up to 3) sent after a configurable delay. These follow-ups are triggered automatically without manual action. To detect a prospect's reply and stop further follow-ups, the platform accesses incoming message metadata (sender address, thread/conversation ID) via the gmail.metadata scope (Gmail) or Graph API (Outlook) β€” no message content is read. When a reply is detected, follow-ups stop and the prospect's status changes to "In Discussion". Users may disconnect their email account at any time from Settings.

8. Intellectual Property

All content on the UGC.Prospect platform (design, code, text) is protected by copyright. Reproduction without authorisation is prohibited. Prospecting data generated remains the property of the user.

9. Account Security

Users are solely responsible for the confidentiality of their login credentials and for all activity carried out from their account. In case of suspected compromise or unauthorised use, users must immediately notify UGC.Prospect at myexperience.ugc@gmail.com.

10. Limitation of Liability

UGC.Prospect strives to provide accurate data but does not guarantee the completeness or accuracy of prospecting information. The service is provided "as is" without any guarantee of commercial results. To the extent permitted by applicable law, UGC.Prospect's liability is limited to amounts actually paid by the user in the preceding 12 months.

11. Changes to Terms

UGC.Prospect reserves the right to modify these terms at any time. Users will be notified by email of any material changes at least 15 days before they take effect. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law & Jurisdiction

These terms are governed by the laws of the Province of Quebec and applicable federal Canadian laws. In case of dispute not resolved amicably, the competent courts shall be those of Quebec. For users residing in the European Union, local consumer protection laws also apply and shall prevail in their scope.

1. Data Collected

We collect: your email address (via Google), your saved searches and prospects, AI-generated messages, and payment information (processed by our secure payment provider β€” we do not have access to your banking details). If you connect an email account, we store a Gmail OAuth token (gmail.metadata scope) or Outlook token, used to send your prospecting emails and, if you activate automatic follow-ups (Premium), to detect prospect replies via message metadata (sender, thread ID) β€” message content is never read.

2. Use of Data

Your data is used to: provide the service, manage your subscription, and improve the platform. We never sell your data to third parties.

3. Legal Basis for Processing (GDPR)

Processing of your data is based on the following legal grounds: (a) Performance of contract (Article 6(1)(b) GDPR) β€” processing necessary to provide the service and manage your subscription; (b) Legitimate interests (Article 6(1)(f)) β€” platform improvement, fraud prevention, security measures; (c) Consent (Article 6(1)(a)) β€” non-essential analytical cookies.

4. Email Open Tracking

When you send emails via UGC.Prospect, an invisible tracking pixel (1Γ—1 image) is included in the email. When the recipient opens the email and loads images, we receive an open notification associated with your prospect. Note: some email clients block automatic image loading (especially Outlook desktop), preventing this tracking. Apple Mail since iOS 15 pre-loads emails, which may generate false positives.

5. Storage & Security

Your data is securely stored via our EU-based hosting provider. We use SSL/TLS encryption for all communications.

6. Data Retention

Your data is retained as follows: active account β€” for the duration of the subscription and up to 3 years after cancellation; prospecting data β€” until deleted by the user or 3 years after last activity; OAuth tokens β€” until account disconnection or revocation; payment data β€” 5 years (legal accounting obligation).

7. International Data Transfers

Some of our providers may process data outside the European Union. In such cases, we ensure appropriate safeguards are in place (European Commission standard contractual clauses or adequacy decisions). Our data is hosted primarily in EU-based data centres.

8. Your Rights (GDPR)

You have the following rights over your data: access, rectification, erasure, objection, restriction of processing, portability (Article 20 GDPR — receive your data in a structured format), and the right to object to processing based on legitimate interests (Article 21 GDPR). You also have the right to lodge a complaint with the Commission d'accès à l'information du Québec (www.cai.gouv.qc.ca) or, for EU residents, the data protection authority in your country of residence. 9. Cookies & Analytics

We use technical cookies necessary for authentication. We also use a privacy-respecting analytics tool (EU server) to measure platform usage in an anonymised manner (pages visited, features used). This tool does not collect your IP address and shares no data with advertisers. No advertising or cross-site tracking cookies are used.

10. Canadian Legal Framework (Law 25 / PIPEDA)

UGC.Prospect is operated from Quebec, Canada. All your data is processed in accordance with Quebec's Act Respecting the Protection of Personal Information in the Private Sector (Law 25) and the federal Personal Information Protection and Electronic Documents Act (PIPEDA). 11. California Users (CCPA / CPRA)

If you reside in California, you have additional rights under the California Consumer Privacy Act (CCPA): the right to know what personal data is collected, the right to deletion, and the right to opt out of the sale of data.
